California Lawmakers Advance Ballot Security and Transparency Measures

In a bid to enhance electoral integrity and promote transparency in political campaigns, California lawmakers have recently approved a series of bills that will bolster ballot security and require more transparency from social media influencers engaged in political campaigns. These bills come as the state's legislature prepares to conclude its two-year session.

One of the key measures involves a requirement for social media influencers to disclose when they are paid by political campaigns to endorse candidates or discuss them positively. Assemblymember Marc Berman (D-Menlo Park), the bill's sponsor, emphasized the importance of ensuring that "voters are not misled by paid content." Under this new legislation, campaigns will also be mandated to report any funds allocated to social media posts, which could potentially result in fines for non-compliance.

The move comes on the heels of the 2026 gubernatorial primary, where candidates, including Democratic billionaire Tom Steyer, paid influencers thousands of dollars to create content that was favorable to them. Notably, some of these influencers did not make it clear that they were being compensated by campaign funds.

Additionally, two bills were sent to Governor Gavin Newsom that would criminalize interference with mail ballots or seizure of ballots and other election materials prior to the certification of the election. These bills were prompted by concerns that President Trump or his supporters may attempt to meddle with the casting and counting of ballots in the upcoming November 3 election.

Riverside County Sheriff Chad Bianco faced both outrage and legal challenges when he ordered his deputies to seize over 650,000 ballots from the county elections office, citing unproven claims of fraud. This case was recently argued before the California Supreme Court. Newsom had earlier signed a bill that prevents law enforcement agencies from taking ballots without a warrant.

Assemblymember Gail Pellerin (D-Santa Cruz) proposed a further measure, which makes it a felony to take or order the seizure of ballots, election records, or voting machines. Such actions would be punishable by up to four years in prison. "The federal administration and those seeking to spread lies about our democracy continue to call for interference in elections in ways we have never seen before in this country," Pellerin stated.

Republican lawmakers argued during previous hearings that the bill is unnecessary since it is already illegal to steal ballots. However, Democrats believe that the additional measure is crucial to safeguarding the democratic process.

Another bill, SB 259, criminalizes interference with a mail ballot in transit or the seizure of ballots en route to a local elections office. With the session drawing to a close, Newsom has until September 30th to sign or veto these bills.

These measures reflect a broader trend in the United States to protect the integrity of elections and ensure transparency in campaign financing. As states grapple with the increasing influence of social media and the potential for misinformation to impact the democratic process, these bills are seen as a significant step towards maintaining the credibility of electoral outcomes.

California's efforts to reinforce its election infrastructure may serve as a model for other states looking to safeguard their own electoral processes. With the midterm elections fast approaching, these measures could have a substantial impact on the outcome of key races and on the broader conversation around campaign finance and voter integrity.
